The spring after my mother passed away, I called an auctioneer that was highly recommended to me, to take and sell some of the larger and more valuable pieces in the estate. He kept them over the summer, then at the end of October he called me up to say come and get the items he hadn’t sold, or he was going to take them to the dump and charge me for it. I got my aunt to help me since she had a pick-up truck, but I was very disappointed in the condition he returned the items. A Victorian bed frame looked like he had dragged it along the roadway. It was badly scratched and gouged and pieces were missing. A three-legged table had all the legs broken off of it. What he did sell went for a tenth of their real value (an 8 foot solid oak bench went for $20 and an oak china cabinet sold for $35). It probably should have tipped me off when he refused to take a reserve price on the pieces. Many items like ornately framed art and chandelier lamps he hadn’t accounted for in his bill of sales – they just disappeared, but he defended this by saying that he sold a lot of stuff as "box lots" and they may have been in one of these. He also tacked on a $200 "handling fee" to his 30% commission. When I complained, he just said that I signed a contract that he was not responsible for the items and that he had a right to add charges if he felt those items cost more for him to lug around than he made from them. I really feel he ripped me off, but at the same, it’s probably too late to do anything about it now. I just wondered if there’s any regulation on how auctioneers in the U.S. run their businesses.
Didn’t you read the contract before you signed? Once you sign, it means you agree to the terms. Now there’s nothing you can do about it LEGALLY. I hope you learned a valuable life lesson.
